Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using our website www.websome.in (the "Site") and all the related services (the “Services”) provided by Websome Design Studio ("us", "we", or "our").
Your access to the Site and use of the Services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Site and/or Services.
If you do not agree with all of these Terms, then you are prohibited from using the Site and Services and you must discontinue use immediately. We recommend that you print a copy of these Terms for future reference.
Websome allows you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Site and/or Services solely for your personal non-commercial use if you are an individual and for your internal use if you are a business.
Except as expressly provided in these Terms and Conditions, no part of the Site, Services or Our Content may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
Unless otherwise indicated, the Site and Services including source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (Our Content) are owned or licensed to us, and are protected by copyright and trade mark laws.
At the time of proposal, We will provide the client with an estimate or quotation by email. The estimate or quotation is to be accepted by the client with an acknowledging email. Alternatively, the client may send an official purchase order in reply to the estimate or quotation. At the time of the client’s acceptance of this estimate or quotation, indicates acceptance of our Terms & Conditions.
Unless agreed otherwise with the client, all design services require an advance payment of a minimum of 50% of the project quotation total before the work commences. The remaining 50% of the project quotation total will be due upon completion of the work.
Charges for any additional services requested during the project that are over and above the estimated time or out of scope, will become fully payable.
The client will be provided with an Invoice prior to final publication. Publication and/or release of work done may not take place before payments have been received.
We don’t want to limit your ability to change your mind. The price at the beginning of this contract is based on the number of days/weeks that we estimate we’ll need to accomplish everything you’ve told us you want to achieve, but we’re happy to be flexible. If you want to change your mind or add anything new, that won’t be a problem as we’ll provide a separate estimate for those additional days/weeks.
We love to show off our work and share what we’ve learned with other people, so we reserve the right, with your permission, to place a by-line at the bottom of your site establishing us as the web site designers, to display and link to your project as part of our portfolio and to write about it on websites, in magazine articles and in books.
You guarantee that all elements of text, images or other artwork you provide are either owned by your good selves, or that you’ve permission to use them. When you provide text, images or other artwork to us, you agree to protect us from any claim by a third party that we’re using their intellectual property.
Any design, copywriting, drawing, idea or code created for the client by Websome, is licensed for use by the client on a one-time only basis and may not be modified, re-used, or re-distributed in any way or form without the express written consent of Websome Design Studio.
Our Site may contain links to third-party web sites or services that are not owned or controlled by Websome.
Websome has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Websome shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
We may terminate or suspend access to our Site and/or Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Site and/or Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Site and/or Services.
